What is A Misdemeanor Offense?

A misdemeanor is a “lesser” criminal act, carrying a less severe punishment than felonies but are more serious than regulatory offenses. Misdemeanors in the United States general have a maximum punishment of 12 months in jail, typically the local jail. Some common misdemeanors include, petty theft, prostitution, public intoxication, simple assault, disorderly conduct, trespassing and vandalism. In addition to full jail time, misdemeanor punishments include probation, community service or part-time imprisonment served on the weekends.

There are several different classes o misdemeanors that carry their own severity of punishment. The lowest level is a Class B Misdemeanor and the highest level is a Class A Misdemeanor that carries a more severe punishment.

What is a Class B Misdemeanor?

Common Class B Misdemeanor charges include one DWI charge, a criminal trespassing charge, theft by check from $50 to $500, and evading arrest or detention. The punishment of a Class B Misdemeanor typically consists of confinement for a term of up to one year in the county jail and/or a fine not to exceed $2,000.

What is a Class A Misdemeanor?

The punishment of a Class A Misdemeanor typically consists of confinement to the county jail for a term of up to one year and/or a fine not to exceed $4,000. Some common Class A Misdemeanor crimes include a second DWI (Driving While Intoxicated) charge, an assault charge, the burglary of a vehicle, and the unlawful carrying of a weapon.

    Does any class of Misdemeanor ever come off your record? What if there is a criminal Traffic offense of speeding 90 in a 75.. is that a misdemeanor in the state of AZ and if so is it ever removed or do you live with that your whole life?

    Hello admin

    I have received two class B misdemeanor charges on me over a couple of checks i wrote that I didnt have the money in the bank to cover. Well It happened in march of 2008. I had no idea about writing checks it was my first check book i had ever had. I knew people could over draw there account and put money back into it to cover it. Well my checks got sent to the DA. I wanted to know how to get these off my record. I have never done anything wrong my record was clean until that.

    i recieved a class A misdemeanor for selling alcohol to a minor. It was a T.A.B.C. sting. I have had a felony before but not drug or alcohol related. I completed my parole 3 years ago. Will this have an affect on the outcome of my situation?

    My 16 yr old son was playing with matches in school and lit upa garbage can they want to charge him with a A misdemeanor the Legal aide said that it won’t be in his records when he gets older is that true?

    hello, I made a facebook about someone else (jokingly) and they found out, the cop at my school said they could charge me with a class A misdemeanor for “identity theft” i wasnt using it to steal information or money, just to make fun of him, is this bad, what do you think the outcome will be?

    What I know at least in the state of Texas is that any petit offenses committed by minors ( under 18 yrs old) wont be displayed in his record once turn 18 yrs old is like if the file got locked and like if the offense never existed.

    to Andrew> the elements of a crime are Actus Reus ( criminal act), Mens Rea ( gulty mind) causation and the harm you produce to victim, even u might not did it with other intention more than make fun of your friend or classmate or whatever she/he is , at the moment you took other’s personal information with out their consense that fact is the crime, so be carefull, I really wish they dont press charges against you and hopefully you learn the lesson Son.     i have a class A1 Misdemeanor SS, is that considered a serious Misdemeanor? will i be able to have it sealed or removed from my record? im still wanting to become SWAT or Secret Service, if not further out my career with the military….

    while at the movies a woman kicked my car i got out and confronted the woman that kicked my car. she started crying and yelling at me stating that she called 911 for help. I got mad and made her drop the phone wat can of charges am i looking at. I have never been in trouble before but i got mad that she kicked my car and my family was in car. Wat can i do? wat am i facing
